The Process
- After a vehicle is detected speeding by either a Fixed Camera or one of the Mobile Van operators, a Notice of Intended Prosecution (NIP) is sent to the last known Registered Keeper within 14 days of the alleged offence. This is the keeper as shown by the DVLA at Swansea.
- The person the NIP is addressed to MUST respond to the NIP either by:
- If they were the driver, going to the 'I was driving' Tab on this website and completing the relevant details.
- If somebody else was the driver, use the 'I was not driving' Tab on this website to advise us of that persons details.
- If the vehicle has been sold a response must still be made using the 'I was not driving' Tab.
- The NIP must not be passed on to somebody else. Failing to complete and return the NIP is an offence.
- Once the nomination is received we will send out a new Notice to the nominated person.
- Once a driver admission is received:
- The driver will, if eligible, automatically be sent an invitation to attend a Speed Awareness Course. They will also have an option to pay the fixed penalty or request a court hearing if they prefer.
- If not eligible for a course they will be sent a Conditional Offer of a Fixed Penalty. They also have the option to request a court hearing.
- If the speed was too fast, the matter will be taken straight to court.
- If a driver fails to complete a course or pay the fixed penalty then the matter will proceed to Court instead. At Court, if found guilty, a Magistrate will decide on the amount of the fine and penalty points. Costs and Victim Surcharge will also be applied.
- Please do not contact this office to ask what happens next or to request a course. The next stage will be sent in the post and you will automatically be offered a course, if you are eligible.
